1. Agreement to Terms

By downloading, installing, or using Daedalus ("the App", "we", "us", "our") — available at daedalus.ai-smarter.org — you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not use the App.

2. Description of the App

Daedalus is a desktop application that uses AI agents to research, build, and ship full-stack web and mobile apps. It provides:

• Market research — grounded research into a market, its competitors and demand, producing a validated brief.
• App building — describe an app and Daedalus plans, writes, runs, and debugs a real full-stack web application on your machine.
• Multi-platform export — deploy to the web, install as a PWA, or export a native Android/iOS project (Capacitor).
• Bring-your-own-keys (BYOK) — you connect your own third-party AI provider accounts and/or local models. You are solely responsible for your use of, and any charges from, those providers.
• Optional integrations — optional connections to third-party tools and to local model runtimes on your machine.

3. Eligibility

To use Daedalus, you must:

• Be at least 16 years old, or have parental/guardian consent where required by your jurisdiction.
• Have a compatible desktop computer (Windows, macOS, or Linux).
• Provide accurate purchase information and keep your license key secure.

We reserve the right to refuse or terminate access at our sole discretion, including for violations of these Terms or abuse of the payment or licensing systems.

4. Licensing and Tiers

Daedalus is a paid, one-time-purchase desktop application, offered in two tiers:

• Basic — a one-time license covering market research, unlimited local app building, all capability recipes, and web deployment.
• Pro — everything in Basic plus Capacitor mobile export (iOS & Android), PWA export, on-demand competitor monitoring, and local-model support, per the pricing shown on our website. You can upgrade from Basic to Pro for the price difference.

Each license is granted to you, node-locked to a limited number of devices, and is non-transferable.

Daedalus uses a bring-your-own-keys model: you connect and pay your own third-party AI providers directly. Your license covers the Daedalus software only — it does not include AI provider usage or any charges from those providers. Prices may change; any change does not affect a purchase already made.

5. Payments and Refunds

Payments are processed by Lemon Squeezy, our Merchant of Record, who handles the transaction, applicable taxes, and payment security. Your purchase is also subject to Lemon Squeezy's buyer terms.

All sales are final. Because the software is delivered and licensed for immediate use upon purchase, we do not offer refunds. By completing a purchase you consent to immediate delivery and acknowledge that you waive any statutory withdrawal or “cooling-off” period that would otherwise apply.

Every license includes ongoing updates and support. If the software does not work for you, contact [email protected] and we will help you get it working.

6. Intellectual Property & Your Creations

The Daedalus application — including its code, design, and all associated content — is protected by copyright and other intellectual property laws and is owned by us. You are granted a limited, non-exclusive, non-transferable license to use the App under these Terms.

You own what you build. The applications, code, and content you create with Daedalus are yours, and you may use them for any lawful purpose, including commercially. We claim no ownership of your output.

You may not:

• Reverse-engineer, decompile, or disassemble the App, or circumvent its licensing.
• Copy, redistribute, resell, or create derivative works from the App itself or its code.
• Remove or alter any copyright, trademark, or proprietary notices.

7. Acceptable Use

When using Daedalus, you agree not to:

• Attempt to gain unauthorised access to our servers, licensing, or infrastructure.
• Share, resell, or circumvent your license, or use it on more devices than permitted.
• Use the App to build anything unlawful, or in any way that violates applicable local, national, or international law.
• Impersonate Daedalus or any other person or entity.

8. Privacy

Your use of Daedalus is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.

9. Disclaimers and Limitation of Liability

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement. AI-generated output may contain errors; you are responsible for reviewing and testing anything you build or ship.

To the maximum extent permitted by law, Daedalus shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by updating the "Last updated" date above. Continued use of the App after changes constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the jurisdiction in which Daedalus operates. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.
